1. Acceptance
By using montepowerelectric.com, requesting an estimate, accepting a quote, or scheduling work with Monte Power & Electric ("Monte," "we," "us," "our"), you ("customer," "you") agree to these Terms & Conditions and to our Privacy Policy. If you do not agree, do not use the site or engage our services.
2. Who we are
Monte Power & Electric is a California-licensed C-10 Electrical Contractor based in San Jose, California, serving residential, commercial, and industrial customers across the South Bay. License number, contractor's bond, and workers' compensation coverage are filed with the California State License Board (CSLB) and available on request.
3. Services
Monte performs electrical contracting work including but not limited to panel upgrades, EV charger installation, rewiring, backup battery systems, generator installation, three-phase motor wiring, transformer installation, A/C and equipment disconnects, tenant improvement electrical, and 24/7 emergency electrical service. Specific scope is defined in the written estimate or contract for each project.
4. Estimates and quotes
Estimates are provided based on a site walk, photographs, plans, or remote review. Each written estimate identifies the scope, materials, labor, permit fees (if applicable), and total price. Estimates are valid for 30 days from the date issued unless otherwise stated in the document. Verbal estimates are non-binding.
If conditions discovered during work materially differ from the conditions assumed in the estimate (concealed damage, non-code wiring, hidden obstructions, AHJ requirements changing scope, PG&E coordination requirements changing scope), Monte will pause, document the change, and present a written change order before proceeding. Customer approval of the change order is required before additional work begins.
5. Permits and inspections
Monte pulls electrical permits with the local Authority Having Jurisdiction (AHJ) when the project requires one and includes the permit fee in the estimate. We schedule inspections, attend AHJ inspections, and deliver final sign-off documentation as part of the project. PG&E coordination on service-entrance work, transformer installs, and meter releases is coordinated by Monte with timing dependent on PG&E's schedule.
6. Scheduling
Project start dates are confirmed in writing once the estimate is signed and the deposit (where applicable) is received. Emergency service is scheduled as soon as a journeyman is available, typically within one hour inside San Jose during normal hours. Scheduling can shift due to weather, AHJ availability, PG&E availability, parts lead times, or prior commitments to existing customers; we communicate changes promptly.
7. Payment terms
- Residential. Final payment is due upon completion and final inspection sign-off. For larger projects, a deposit may be required at signing and progress payments at agreed milestones, all stated in the estimate.
- Commercial. Net 30 or Net 60 terms are available on commercial projects subject to credit review. Terms are confirmed in writing on each estimate. Property management portfolios may be billed monthly under a recurring service agreement.
- Accepted payment methods. Check, ACH transfer, and major credit cards. A processing surcharge may apply to credit card payments on larger invoice amounts. The exact threshold is noted on the estimate.
- Late payment. Invoices unpaid after 30 days from the due date accrue interest at the lesser of 1.5% per month or the maximum rate allowed by California law. Reasonable collection costs and attorneys' fees on overdue accounts may be charged to the customer.
- Mechanic's lien rights. Monte reserves the right to file a mechanic's lien on the property under California Civil Code ยง8000 et seq. for unpaid amounts. A preliminary 20-day notice may be issued at the start of work.
8. Warranty
Monte warrants its workmanship for one year from the date of completion. If a defect in workmanship surfaces during that year, contact us and we will return to correct the issue at no charge. Manufacturer warranties on equipment (panels, EV chargers, batteries, generators, transformers, etc.) are separate and follow the manufacturer's terms; we will help you file a manufacturer warranty claim when applicable.
The warranty does not cover: damage caused by misuse, modification, accident, fire, flood, vandalism, rodent or pest damage, third-party work performed after our completion, acts of God, power surges from utility events, or normal wear. The warranty is not transferable to subsequent property owners unless agreed in writing.
9. Limitation of liability
Monte's total liability for any claim arising out of a project is limited to the amount paid by the customer for that project. Monte is not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, business interruption, or loss of data, even if advised of the possibility of such damages. This limitation does not apply where prohibited by California law, including liability for personal injury or death caused by negligence.
10. Insurance
Monte maintains general liability insurance with coverage limits of $2,000,000 per occurrence, plus workers' compensation coverage as required by California law. Certificates of insurance are available on request and can be issued naming a property owner, general contractor, or property manager as additional insured for a specific project.
11. Customer obligations
- Provide accurate information about the property, the existing electrical system, and the project scope.
- Provide reasonable access to the work area, electrical panels, attics, crawl spaces, and exterior service points during scheduled work hours.
- Identify any concealed wiring, low-voltage runs, alarm systems, or solar systems before work begins.
- Secure the work area from children, pets, and unauthorized persons during active work.
- Pay invoices on time and according to the terms in the estimate.
12. Force majeure
Neither party is liable for delay or failure to perform due to events beyond reasonable control, including natural disaster, fire, flood, earthquake, public-safety power shutoffs (PSPS), pandemic, war, civil unrest, government action, supplier failure, or labor disruption. Affected work will be rescheduled as soon as conditions allow.
13. Cancellation and refunds
You may cancel a signed contract within three business days of signing without penalty under the California Home Solicitation Sales Act, where it applies. After that, cancellations may be subject to charges for materials already ordered, time already worked, and a reasonable cancellation fee, all stated in the estimate. Deposits applied to permits, special-order materials, or equipment already shipped are typically non-refundable.
14. Disputes and governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. The parties will attempt to resolve any dispute first by direct, good-faith negotiation. If negotiation fails, the dispute will be submitted to binding arbitration in Santa Clara County, California, under the rules of the American Arbitration Association, except that either party may bring small-claims actions and Monte may pursue mechanic's lien rights in court. The arbitrator's award is final and may be entered in any court of competent jurisdiction.

15. Website use
The website and its content are provided for informational purposes. Project examples, pricing ranges, response-time figures, and code references are provided in good faith but may change without notice. Photographs of completed work may include third-party trademarks (PG&E, Tesla, ChargePoint, etc.) used only to identify equipment installed; no endorsement is implied.
You may not scrape, frame, mirror, or systematically copy the website's content. Reasonable individual use (saving a page for reference, sharing a link) is fine.
16. Intellectual property
The Monte Power & Electric name, logo, mountain-and-bolt mark, and all original photography and copy on the website are the property of Monte Power & Electric. The site is built and maintained for Monte by its design partner; underlying code is not licensed for reuse on other projects without written consent.
17. Severability
If any provision of these Terms is found unenforceable, the remaining provisions stay in force. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
18. Changes to these Terms
We may update these Terms from time to time. The effective date at the top of the page reflects the most recent version. Changes apply to projects scoped after the effective date; existing signed contracts continue under the Terms in force when they were signed.
